Fees and Costs at Wood Injury Law

At Wood Injury Law, we represent Arizona injury victims on a contingency-fee basis. That means no out-of-pocket cost to you and no fee unless we win.

Your first consultation with attorney Josh Wood is free. We review the facts of your case, explain your options, and answer your questions. There is no obligation to hire us, and there is never any pressure to do so.

No recovery, no fee

You pay nothing out of pocket. Our attorney’s fee is a percentage of the amount we recover for you, and we only collect that fee if we win. If we do not recover compensation for you, you owe us no attorney’s fee.

Percentage of recovery

Our standard contingency fee is a percentage of the gross recovery. The exact percentage depends on whether your case settles before or after litigation is filed, and is stated clearly in the written fee agreement you sign before we begin representing you. Under Arizona Rule of Professional Conduct 1.5, all fee arrangements in contingent-fee cases must be in writing and must clearly disclose how the fee is calculated.

Case costs

In addition to attorney’s fees, certain costs are incurred while building your case: medical records, accident reports, expert witnesses, filing fees, deposition transcripts. We typically advance these costs and are reimbursed from the settlement or verdict at the end of the case. If there is no recovery, in most cases you do not owe us for costs either. The exact treatment of costs is spelled out in your fee agreement.

Medical liens and subrogation

Health insurers, Medicare, Medicaid, and some medical providers may have a right to be repaid from your settlement. We negotiate these liens to reduce what you owe so that more of the recovery stays with you.

What you take home

Your net recovery is the settlement or verdict minus the contingency fee, minus any advanced costs, minus any medical liens and subrogation claims. We give you a clear, itemized closing statement at the end of the case showing exactly where every dollar went.
